Acceptable Use Policy

1. Introduction
This Acceptable Use Policy ("AUP") applies to all users of the Mindhyv platform, including our websites, mobile applications, APIs, and any other services operated by Mindhyv, LLC ("Mindhyv," "we," "us," or "our"). It governs the conduct of registered users, creators, marketplace participants, developers, and visitors alike.
By accessing or using any part of our ecosystem, you agree to comply with this AUP. Violations may result in enforcement actions up to and including permanent account termination and referral to law enforcement. This policy is incorporated by reference into our Terms of Service.
2. Prohibited Content
You may not upload, post, transmit, distribute, or otherwise make available any content that:
Illegal Material
Violates any applicable local, state, national, or international law or regulation, including content that facilitates or promotes illegal activity of any kind.
Child Sexual Abuse Material (CSAM)
We maintain a zero-tolerance policy toward child sexual abuse material. Any content that sexually exploits or abuses minors — whether real or AI-generated — is strictly prohibited. We are legally obligated to and will immediately report all CSAM to law enforcement, including the National Center for Missing and Exploited Children (NCMEC) and relevant international authorities. Accounts associated with such content will be permanently banned and all relevant data preserved for investigators.
Violence and Threats
Content that glorifies, incites, or threatens real-world violence against any individual, group, or entity, including graphic depictions of extreme violence intended to shock or harm.
Hate Speech
Content that promotes hatred, discrimination, or dehumanization of individuals or groups based on characteristics including but not limited to race, ethnicity, national origin, religion, gender, gender identity, sexual orientation, disability, or age.
Harassment and Doxxing
Content designed to harass, bully, intimidate, or stalk specific individuals, or that exposes private personal information (such as home addresses, phone numbers, or financial details) of others without their explicit consent ("doxxing").
Spam and Unsolicited Communications
Unsolicited bulk messages, commercial solicitations, chain letters, pyramid schemes, or any other form of spam sent through our platform's messaging, notification, or content systems.
Malware and Malicious Code
Files, links, or code designed to disrupt, damage, or gain unauthorized access to any computer system, network, or device, including viruses, worms, ransomware, spyware, trojans, and other malicious software.
Impersonation
Content that falsely represents you as another person, organization, brand, or entity in a manner intended to deceive others, including impersonating Mindhyv staff, public figures, or other platform users.
Misinformation and Disinformation
Deliberately false or misleading content that poses a significant risk of real-world harm, including fabricated health claims, election interference, or coordinated inauthentic narratives intended to deceive the public at scale.
3. Prohibited Behavior
In addition to content restrictions, the following behaviors are prohibited on our platform:
Platform Manipulation
Artificially inflating engagement metrics such as views, likes, followers, or ratings through coordinated inauthentic activity, purchased engagement, or any other deceptive means.
Unauthorized Data Scraping
Extracting, harvesting, or collecting data from our platform — including user profiles, content, or other information — using automated tools without our prior written authorization.
Automation Without Authorization
Using bots, scripts, crawlers, or other automated means to access or interact with the platform in ways not explicitly permitted by our API terms or written authorization from Mindhyv.
Security Circumvention
Attempting to probe, scan, or test the vulnerability of our systems; bypassing authentication or access controls; or engaging in any activity that could compromise the security or integrity of the platform or its users' data.
Interference with Platform Operations
Taking any action that imposes an unreasonable or disproportionately large load on our infrastructure, or that disrupts, degrades, or interferes with the normal functioning of the platform for other users.
4. Marketplace-Specific Rules
Users participating in the Mindhyv Marketplace — whether buying, selling, or listing products, services, or jobs — must also comply with the following rules:
Counterfeit Goods
Listing, selling, or promoting counterfeit goods — items that falsely bear the trademark of another brand — is strictly prohibited.
Infringing Products
Products or services that infringe upon the intellectual property rights of third parties, including unauthorized reproductions, copies, or derivatives of copyrighted works, are not permitted on our marketplace.
Dangerous or Illegal Items
Listings for items that are illegal to sell, possess, or transfer in the applicable jurisdiction, or that pose a serious safety risk to buyers or the general public, are prohibited.
Fraudulent Practices
The following fraudulent marketplace behaviors are prohibited:
- Price manipulation: coordinating with other sellers to fix, inflate, or otherwise manipulate pricing.
- Fake reviews: submitting, soliciting, or purchasing fraudulent reviews or ratings for any listing.
- Shill bidding: using secondary accounts or third parties to artificially drive up prices in any auction or bidding context.
- Misrepresentation: materially misrepresenting the nature, condition, origin, or features of any listed product or service.
5. AI-Specific Restrictions
Mindhyv provides AI-powered tools and integrations across the platform. Use of these capabilities is subject to all other provisions of this AUP, as well as the following AI-specific restrictions:
- Illegal content generation: using AI tools to generate any content that would otherwise violate this AUP, including illegal material, CSAM, threats, or hate speech.
- Deepfakes without consent: creating or distributing AI-generated synthetic media (audio, video, or images) that realistically depicts a real person without their explicit consent, particularly in misleading or harmful contexts.
- AI-powered impersonation: using AI tools to impersonate another person, brand, or entity in a deceptive manner, including generating content designed to appear as if it originates from someone else.
- Mass automated spam: leveraging AI to generate and distribute unsolicited bulk content or communications at scale across the platform.
- Bypassing AI safety measures: attempting to circumvent, jailbreak, or otherwise subvert the safety systems, content filters, or usage policies embedded in any AI tool or model made available through our platform.
6. Enforcement
We reserve the right to investigate suspected violations of this AUP and to take appropriate action at our sole discretion. Enforcement follows a graduated approach based on the severity, frequency, and context of the violation:
- Warnings: for first-time or minor violations, we may issue a formal warning and require acknowledgment of the policy.
- Content removal: violating content will be removed from the platform, with or without prior notice.
- Temporary suspensions: depending on severity, accounts may be suspended for 24 hours, 7 days, or 30 days. During suspension, access to the platform and its features is restricted.
- Permanent bans: for serious or repeat violations, accounts may be permanently deleted. Upon permanent ban, any remaining account balance or earned credits may be forfeited in accordance with our Terms of Service.
- Law enforcement referrals: violations involving criminal activity — including but not limited to CSAM, credible threats of violence, and fraud — will be reported to appropriate law enforcement agencies. We will preserve and provide all relevant data as required by law.
7. Appeals
If you believe an enforcement action taken against your account was made in error, you have the right to appeal. The following conditions apply:
- Appeal window: you must submit your appeal within 30 days of receiving notice of the enforcement action. Appeals submitted after this window may not be considered.
- Independent review: appeals are reviewed by a team member who was not involved in the original enforcement decision.
- Decision timeline: we will issue a decision on your appeal within 14 business days of receipt. You will be notified of the outcome via the email address associated with your account.

8. Reporting Violations
We rely on our community to help keep the platform safe. If you encounter content or behavior that you believe violates this AUP, please report it using one of the following methods:
- In-platform reporting tools: use the "Report" option available on content, profiles, and listings throughout the platform.
- Email: send a detailed report to [email protected]. For CSAM specifically, also report to NCMEC's CyberTipline.
- Urgent threats: if you believe someone is in immediate danger, contact your local emergency services first, then notify us at [email protected].
We take all reports seriously and will investigate them in a timely manner. Reports made in good faith will be kept confidential to the extent permitted by law.
9. Changes to This Policy
We may update this Acceptable Use Policy from time to time to reflect changes in our platform, applicable law, or industry standards. For material updates, we will provide at least 15 days' advance notice via email to the address associated with your account and by posting a notice on the platform.
In cases where an update is required for urgent legal or compliance reasons, we may implement changes immediately without prior notice. Continued use of the platform after the effective date of any update constitutes your acceptance of the revised policy.
